2. SCOPE
These Terms apply to individual Kundalini Awakening sessions, Kriya Yoga sessions, workshops, online sessions, events and similar services offered by Codes of Grace.
Kundalini Awakening Facilitator Trainings and other professional training programs are subject to a separate written Training Agreement. Where a separate agreement has been entered into, the provisions of that agreement take precedence over these General Terms & Conditions in relation to the respective training.
3. BOOKING AND CONTRACT FORMATION
Bookings for events, workshops and sessions are generally made through the booking or payment options provided by Codes of Grace.
Unless otherwise stated, a booking becomes binding once payment has been successfully completed and the booking has been confirmed.
By completing a booking, you confirm that the information you have provided is accurate and that you are at least 18 years old.
4. PRICES AND PAYMENT
The price displayed for the respective event, workshop or session at the time of booking applies.
Unless otherwise stated, payment is due in full at the time of booking.
Payments may be processed through external payment providers such as Stripe. Where an external payment provider is used, its own terms and privacy practices may also apply.
Any additional costs associated with participation, including travel, accommodation, meals or insurance, are the responsibility of the participant unless expressly stated otherwise in the respective offer.
5. CANCELLATION & REFUND POLICY
Bookings for date-specific events, workshops and sessions are non-refundable, unless otherwise expressly stated for the respective event or required by applicable law.
If you are unable to attend, you may transfer your place to another person at no additional charge. Please inform us at hello@codesofgrace.com before the event and provide the name and contact details of the person attending in your place.
Any replacement participant must meet the applicable participation and health requirements.
Codes of Grace may, at its sole discretion, offer a refund, credit or transfer to another event in individual circumstances. Any such accommodation is voluntary and does not create an entitlement to the same treatment in future cases.
Where mandatory consumer protection law provides you with rights that cannot legally be excluded, those rights remain unaffected.
For certain services related to leisure activities that are provided on a specific date or during a specific period, statutory withdrawal rights may not apply under applicable consumer law.
6. CANCELLATION BY CODES OF GRACE
If Codes of Grace cancels an event, workshop or session and no suitable replacement is offered, you will receive a full refund of the participation fee paid.
Where appropriate, we may offer you the option to transfer your booking to another event or date instead. The choice to accept such a transfer remains yours.
Codes of Grace is not responsible for additional expenses incurred in connection with participation, including travel, flights, accommodation, visa costs or other personal expenses, except where liability cannot legally be excluded.
For events involving travel, we recommend booking flexible travel arrangements and, where appropriate, suitable travel or cancellation insurance.
7. CHANGES TO EVENTS
Sometimes circumstances beyond our reasonable control or organizational requirements may make changes necessary.
Codes of Grace reserves the right to make reasonable changes to the schedule, timing, location, facilitators or format of an event, provided that the essential nature and overall value of the event are maintained.
Where a material change significantly affects the agreed service, any rights available to you under applicable law remain unaffected.
8. HEALTH & PARTICIPATION
Our offerings may include Kundalini Awakening, Himalayan Kriya Yoga, breath, movement, meditation, embodiment practices and other practices involving physical, emotional, energetic or spiritual exploration.
These practices can be experienced intensely and may involve physical sensations, spontaneous movement, emotional responses, changes in perception or other individual experiences.
Every participant is responsible for assessing whether participation is appropriate for their individual physical and mental condition.
You are always encouraged to listen to your body and your own boundaries. You may pause, modify or discontinue a practice at any time.
If you experience pain, significant discomfort, overwhelm or feel unable to continue safely, you should stop the practice and inform the facilitator where appropriate.
Participation is always voluntary.
9. HEALTH CONDITIONS & PRIOR CONSULTATION
Certain physical or mental health circumstances may require additional care or may make participation inappropriate.
Please contact us before participating if any of the following applies to you:
* pregnancy from the third month onwards
* epilepsy or a history of seizures
* serious cardiovascular conditions
* recent surgery or significant medical procedures
* serious mental health or psychiatric conditions
* a history of psychosis or other conditions involving significant alterations in perception or reality
If any of these circumstances apply, or if you are otherwise uncertain whether participation is appropriate for you, you are responsible for seeking advice and, where appropriate, medical clearance from a suitably qualified healthcare or mental health professional before participating.
Codes of Grace does not provide medical assessments and cannot determine whether participation is medically appropriate for you.
Any communication from Codes of Grace confirming that your participation can be accommodated does not constitute medical advice, medical clearance or a guarantee that participation is risk-free.
You remain responsible for:
* providing complete and accurate information about circumstances relevant to safe participation
* seeking professional medical or mental health advice where appropriate
* following any advice or restrictions given by your healthcare professional
* monitoring your own physical and mental wellbeing before and during participation
* stopping or modifying a practice if you experience pain, significant discomfort, overwhelm or other concerning symptoms
Codes of Grace cannot assess risks arising from health information that has not been disclosed to us.
Where we reasonably believe that participation may present an inappropriate risk to you or others, we reserve the right to decline or discontinue participation.
Participation during an acute psychotic episode or other acute severe psychiatric condition is not permitted.
Nothing in this section is intended to provide medical advice or to replace consultation with a qualified healthcare professional. If you have any doubt about whether participation is suitable for you, please obtain appropriate professional advice before attending.
10. NO MEDICAL OR THERAPEUTIC TREATMENT
Codes of Grace offerings are intended for personal development, wellbeing and spiritual exploration.
They are not medical, psychological, psychiatric or psychotherapeutic treatment and are not intended to diagnose, treat, cure or prevent any medical or mental health condition.
Our facilitators do not replace doctors, psychotherapists, psychiatrists or other licensed healthcare professionals.
Nothing communicated during an event, session or workshop should be understood as medical or mental health advice.
If you have concerns about your physical or mental health, please consult an appropriately qualified healthcare professional.
11. NO GUARANTEE OF RESULTS
Every person experiences this work differently.
We do not guarantee any particular physical, emotional, energetic, spiritual, therapeutic, personal or professional result from participation.
Descriptions of experiences, transformations or benefits on our website, social media, testimonials or other materials represent possibilities or individual experiences and should not be understood as promises or guarantees of a particular outcome.
12. PERSONAL RESPONSIBILITY
By participating, you acknowledge that you remain responsible for your own choices, boundaries and wellbeing throughout the event or session.
You agree to follow reasonable safety instructions given by the facilitator and to communicate where appropriate if you experience difficulties during participation.
You are free to decline, modify or stop any practice at any time.
Nothing in these Terms requires you to participate in a practice that does not feel appropriate for you.
13. PHOTOGRAPHY AND FILMING
Photography or filming may take place at selected Codes of Grace events for documentation, communication and promotional purposes, including use on our website and social media channels such as Instagram and Facebook.
We aim to respect the privacy and personal nature of the work.
Where participants are individually identifiable and recordings are intended for promotional or social media use, appropriate consent will be obtained where required.
Participants who do not wish to appear in photographs or video recordings are encouraged to inform us or the photographer at the beginning of the event.
We will not intentionally use close-up recordings of participants during vulnerable, highly emotional or deeply personal processes for promotional purposes without appropriate consent.
14. CONFIDENTIALITY AND RESPECT FOR OTHER PARTICIPANTS
Our events are intended to provide a respectful environment in which participants can explore personal experiences safely.
Participants may share personal information, emotions or experiences during group sessions.
You agree to respect the privacy of other participants and not to disclose personal information, stories or experiences shared by another participant without their permission.
Photography, filming or recording of other participants by attendees should not take place without their consent.
We reserve the right to ask a participant to leave an event if their conduct is unsafe, seriously disruptive, abusive, discriminatory, threatening or repeatedly violates the boundaries or privacy of others.
15. ONLINE SESSIONS
For online events and sessions, participants are responsible for ensuring that they have:
* a suitable internet connection
* a functioning device
* an appropriate and private space for participation
* any equipment communicated as necessary before the session
Technical difficulties occurring on the participant’s side do not generally create an entitlement to a refund.
If an online session cannot take place because of a technical problem on our side, we will offer an appropriate replacement date, credit or refund.
16. INTELLECTUAL PROPERTY
Unless otherwise stated, all materials provided by Codes of Grace, including texts, videos, recordings, exercises, practices, graphics, manuals and other educational materials, remain the intellectual property of Solemn Solutions LLC or the respective rights holder.
Materials are provided for your personal use unless expressly agreed otherwise.
They may not be copied, reproduced, published, sold, distributed, uploaded, commercially exploited or made available to third parties without prior permission.
17. LIABILITY
Participation in our events and sessions takes place within the framework described in these Terms and requires participants to take appropriate responsibility for their own wellbeing and choices.
Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.
In particular, mandatory statutory liability for intentional misconduct, gross negligence, injury to life, body or health, or other liability that cannot legally be excluded remains unaffected.
To the extent permitted by applicable law, Codes of Grace is not responsible for losses resulting from circumstances outside our reasonable control or from a participant’s failure to follow reasonable safety instructions or disclose information relevant to safe participation.
18. FORCE MAJEURE
Codes of Grace is not responsible for delays, changes or inability to perform an event caused by circumstances beyond our reasonable control.
These may include, for example, natural disasters, severe weather, government restrictions, epidemics, transportation disruptions, venue closures or other comparable circumstances.
Where an event cannot reasonably take place, we will seek an appropriate solution, which may include rescheduling, transferring the booking, providing an alternative format or issuing a refund where required by applicable law.
19. CONSUMER RIGHTS
Nothing in these Terms is intended to restrict rights granted to consumers under mandatory applicable consumer protection law.
Where a participant qualifies as a consumer within the European Union or another jurisdiction providing mandatory consumer protections, those protections remain applicable to the extent required by law.
For date-specific services relating to leisure activities, a statutory right of withdrawal may be excluded under applicable law.
20. FACILITATOR TRAININGS
Kundalini Awakening Facilitator Trainings and other professional training programs offered by Codes of Grace are governed by a separate written Training Agreement.
The Training Agreement may contain specific provisions regarding fees, payment plans, cancellations, attendance, certification, intellectual property, confidentiality, health and participation requirements and other matters specific to the training.
Where the Training Agreement differs from these General Terms & Conditions, the Training Agreement takes precedence in relation to that training.
21. GOVERNING LAW
These Terms and the contractual relationship between Codes of Grace and the participant are governed by the applicable law determined under relevant conflict-of-law rules.
Nothing in these Terms deprives consumers of mandatory protections granted to them under the law that applies to them and that cannot lawfully be excluded by agreement.
22. SEVERABILITY
If any provision of these Terms is found to be invalid, unenforceable or ineffective, the remaining provisions will remain unaffected to the extent permitted by applicable law.
23. CHANGES TO THESE TERMS
We may update these Terms from time to time.
The version applicable to a booking is generally the version made available at the time the booking was completed, unless a later change is required by law or expressly agreed between the parties.
